DailySync Terms of Service
Omvistech, Inc. (“Omvistech” or “We”), the developer of the DailySync application and Service, requires users of the DailySync application to agree to the Terms of Service (“TOS”) as described in this document. The term “Service” refers to both the services provided by the DailySync mobile application and the dailysync.com website.
YOU ACKNOWLEDGE AND AGREE THAT BY USING THE DAILYSYNC APPLICATION AND SERVICE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THE TERMS OF SERVICE, THEN YOU HAVE NO RIGHT TO ACCESS THE SERVICE.
The TOS may be modified at any time in the future and without prior notice. The updated TOS will be published on this page.
Service availability
We reserve the right to modify or terminate the services provided by the DailySync application and website at any time and without prior notice.
Third Party Services and Content
You can access content from Third Party Sites and Services, including, for example, social networks such as Facebook and Twitter, other websites and blogs. By accessing the Third Party Content you agree to abide by the terms of service governing that content. By accessing the Third Party Services via DailySync application both for reading and posting content, you agree to abide by the term of service of those Third Party Services. You acknowledge and agree that we are not responsible for the accuracy and availability of the Third Party Services and Content.
You acknowledge that Omvistech: a) is not responsible for the accuracy or availability of the Third Party Services and Content; b) has no liability for any harm, suffering or losses caused by the access or use of Third Party Services and Content.
Copyright
You agree not to use DailySync application and Service to display, distribute or provide access to any material that infringes on the copyright owned by another party or violates the intellectual property rights of other parties.
Ownership
The DailySync Application and Service is protected by copyright, trademark and other laws of the United States and other countries. You agree that by providing feedback or comments regarding the DailySync Application and Service you are irrevocably granting Omvistech the sole will and exclusive property rights to your feedback.
Disclaimer
The DailySync application and Service, the access to Third Party Content and Services are provided “as is”, without warranty of any kind, either express or implied. Omvistech does not provide any warranty that the DailySync application and Service will provide services in an uninterrupted, secure and error-free basis.
Indemnity
You agree to defend, indemnify, and hold Omvistech, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses and expenses, arising from the use of DailySync application and service.
Limitation of Liability
You acknowledge and agree that, to the maximum extent permitted by law, your use of the DailySync application and services is entirely at your own risk. Neither Omvistech nor any party involved in the creation and/or delivery of content and services accessible from DailySync application and website will be liable for any incidental, special, exemplary or consequential damages, including lost profits or goodwill.
